STATEMENTS MADE BY INDEPENDENT BROADCASTERS DURING LIVE CHAT DO NOT REFLECT THE OFFICIAL POSITIONS OR POLICIES OF JOIN-CHATURBATE.COM.

12. Limitation of Liability & Allocation of Commercial Risk

UNDER NO LEGAL THEORY, WHETHER IN TORT (INCLUDING NEGLIGENCE), CONTRACT, STRICT LIABILITY, OR OTHERWISE, SHALL JOIN-CHATURBATE.COM, ITS DIRECTORS, SHAREHOLDERS, EMPLOYEES, AFFILIATES, OR PAYMENT PROCESSORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES.

THIS LIMITATION APPLIES TO DAMAGES FOR LOSS OF PROFITS, LOSS OF REPUTATIONAL GOODWILL, DATA CORRUPTION, SERVICE INTERRUPTION, COMPUTER FAILURE, PHYSICAL INJURY, OR EMOTIONAL DISTRESS ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE SERVICE. IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY TO YOU EXCEED THE GREATER OF ONE HUNDRED UNITED STATES DOLLARS ($100.00 USD) OR THE EXACT AMOUNT OF VIRTUAL TOKEN FEES YOU PAID TO THE PLATFORM DURING THE SIX (6) MONTHS PRECEDING THE CLAIM.

13. Mandatory Binding Individual Arbitration & Class Action Waiver
